Regulations on Provision of Special Information by Open Joint Stock Companies and Bond Issuers, approved by Decision of the SEC No. 5 dated February 10, 2000 (registered with the Ministry of Justice of Ukraine on February 28, 2000 under No. 108\/4329) as amended by Decision of the SEC No. 295 dated June 24, 2003. On the day appointed for consideration of the case on the offense, it was established that the company had paid for the publication of the announcement on changes in the personal composition of the officers by payment order No. 74 dated 22.05.03. The company was not guilty of late publication of the information. Therefore, there is no corpus delicti of the offense. Taking into account the above, based on subparagraph 2) of paragraph 8.4, guided by paragraph 3.4 of the \"Rules for Consideration of Cases on Violation of Legislation on the Securities Market and Application of Sanctions\", approved by the Order of the State Commission on Securities and Stock Market dated 09.01.97 No. 2 (as amended by the decision of the State Commission on Securities and Stock Market dated 13.02.01 No. 27, registered with the Ministry of Justice of Ukraine on 16.03.01 under No. 243\/5434)<\/p>\n\n\n\n RESOLVED:<\/p>\n\n\n\n 1. To close the case against OJSC \"Ichnianskyi Zavod Prodtovoriv\" due to the absence of elements of an offense. 2. For accounting and control purposes, a copy of the resolution shall be sent to the Legal Department of the SSMSC.
